Privacy Policy

This Privacy Policy describes how CO2 Exchange LLC (“Soda Sense,” “we,” “us,” “our”) collects, uses, retains, shares, and protects your personal information when you (1) visit or make a purchase from www.sodasense.com (the “Site”); (2) communicate with us on the Site via email, chat, and other electronic messages; (3) create a customer account on our Site; and (4) otherwise interact with us online or offline, including by telephone.

This Privacy Policy does not apply to information collected or used by any third party or affiliate, including any such party that may link to, or be accessible, via our Site. Soda Sense is not responsible for the content or the privacy policies or practices of any third parties, third-party websites or third-party apps. We process personal information, as described below, on the basis of our legitimate interest in fulfilling our service commitment to you.

Before accessing, using, or interacting with the Site, you should carefully review this Privacy Policy and our Terms and Conditions. We may change this Privacy Policy from time to time and encourage you to review them whenever you interact with us.

User Consent: By choosing to interact with Soda Sense, including through our Site and by communicating with us via email, telephone or in person, you consent to the collection and use of information as described in this Privacy Policy and you represent that you are at least 18 years old. If you are under the age of 18 or you do not consent to the collection, use and/or disclosure of your personal information as set forth in this Privacy Policy, please exit and do not use our Site or other applications or services.

Personal Information We Collect

For purposes of this Privacy Policy, unless otherwise noted, the term “personal information” means information that identifies, relates to, describes, references, is reasonably capable of being associated with or could reasonably be linked, directly or indirectly, with a particular person or household.

Information You Give Us Directly

When you make a purchase, attempt to make a purchase, or create an account through the Site, we, along with our trusted third-party providers, collect certain information from you including your name, billing address, shipping address, payment information (including credit card numbers, which are not saved or used outside of Shopify!), email address, phone number, and consumption habits of you and your household. When you are checking out on our Site, we utilize a proprietary application to validate the postal address you provided to us. We refer to this information as “Order Information.”

In order to provide you with the best support possible, when you contact us through the Site, email us, or request customer support through our online form or chat feature, we may ask for your name, email, telephone number, and any other information that might help us fulfill your request.

Information We Collect Automatically

When you interact with our Site, open or click on emails we send you, add products to your online shopping cart, or interact with advertisements, we or our service providers automatically collect certain information about your device, including your IP address, time zone, information about the individual web pages or products that you view, what websites or search terms referred you to the Site, and information about how you interact with the Site. We collect this information using online tracking technologies such as cookies, pixels, web beacons, and log files. Information collected from third parties

You may connect with Soda Sense or one of its websites through social networking websites, such as Facebook (Meta), Twitter (X), or Pinterest. Please note, any content or information you disclose to third parties regarding Soda Sense, your communications with Soda Sense, or using or related to the Site may not be private or confidential. If you interact with Soda Sense on social networks, such as by “Liking” a Soda Sense product on Facebook or Twitter, you are allowing that social networking site to provide us with information from your Facebook or Twitter profile. Whenever submitting information on a social network website you should familiarize yourself with their privacy policy and practices.

Cookies and Similar Online Tracking Technologies

We and our third-party partners and service providers (such as Shopify, advertising networks, analytics providers and social media platforms and networks) use cookies, pixels, web beacons, and other similar online tracking technologies (collectively, “online tracking technologies”) to gather information when you interact with our Site and email communications. Some online tracking technologies help us maintain the security of our Site and your account, prevent crashes, fix bugs, save your preferences, and assist with basic site functions.  

Soda Sense uses Google Analytics to collect anonymized data points about how visitors use our Site, including the number of visitors to the Site, from where visitors navigated to get to our Site, and the webpages. This information is collected and maintained in an anonymous form and used to help us improve our Site. If you choose to opt-out of Google Analytics, you can install a browser add-on in your browser across all websites (please note that Soda Sense is not responsible for the content of external websites). 

We also permit third parties and service providers to use online tracking technologies, including cookies and pixels such as the Meta Pixel and Google Tag Manager, on our Site for tracking users who navigate from social media sites to our Site for purchasing or reviewing products and for advertising purposes, including tailoring advertisements and marketing communications we believe may be of interest to you. These advertisements may appear on other websites. You can opt out of targeted advertising by using the links below:

We also use an application that integrates data collected with the tracking technologies we use and Shopify, so we can gain a better understanding of the analytics we collect and the advertising we do on other sites.  

How We Use Your Personal Information

Soda Sense may use and process information about you, including personal information, for one or more of the legitimate business purposes described in this Privacy Policy. For example, Soda Sense (and/or our service providers) may use information about you to:

- Fulfill or meet the reason your information was collected or provided;

- Fulfill any orders placed through the Site (including processing your payment information, arranging for shipping, and providing you with invoices and/or order confirmations);

- Communicate with you (including providing support, responding to requests, or notifying you about changes to our services);

- Screen our orders for potential risk or fraud;

- When in line with the preferences you have shared with us, to provide you with news, special offers, and general information about other goods, services, and events which we offer that are similar to those that you have already purchased or inquired (for more information, see our Cookies and Similar Online Tracking Technologies section above);

- Improve and optimize our Site (including generating analytics about how our customers browse and interact with the Site, and assess the success of our marketing and advertising campaigns);

- Present, optimize, and maintain the security of our Site;

- Register, maintain, and provide notifications to you about your account;

- Respond to law enforcement requests, and as required by applicable law or court order;

- Allow you to participate in interactive features on our Site;

- Personalize your Site experience and to deliver content, product, and service offerings relevant to your interests, including targeted offers through our Site, third-party sites, and via email.

How We Share Your Information

We do not believe that we “sell” your personal information as a “sale” or “selling” is defined by applicable privacy laws, and, accordingly, we do not offer a “do not sell” opt-out. We will not and would not sell personal information that we collected without giving you an opportunity to opt-out and unless we first give you notice of our intent to sell and an express opportunity to opt-out of that sale.

Service Providers

We share your Personal Information with a limited number of service providers that perform services to support our core business functions and internal operations including: fulfilling orders, complying with your request for shipment and delivery of orders, sending post mail and emails, analyzing customer data, providing marketing assistance, supporting beacons, processing credit card and debit card payments, investigating fraudulent activity, and providing customer service. We have entered into contracts with these third-party service providers that require personal information be kept confidential, as appropriate, and prohibit the retention, use, or disclosure of personal information for any purpose other than the services specified.

We may also disclose personal information internally within Soda Sense. Our personnel may have access to personal information as needed to provide our services and operate the Site in the normal course of business.

Business Transfers

If we purchase other businesses or their assets, sell our business assets, or are involved in a bankruptcy, merger, acquisition, reorganization or sale of assets, your information, including any category of personal data collected by Soda Sense, may be among assets sold or transferred and may be subsequently used by a third party.

Legal Compliance and Safety

We may also share your Personal Information to comply with applicable laws and regulations, to respond to a subpoena, search warrant or other lawful request for information we receive, to prevent fraud or illegal activity, protect the safety of any person, or to otherwise protect our rights and interests. Nothing in this Privacy Policy is intended to limit any legal defenses or objections that you may have to a third party’s, including a government’s, request to disclose your information.

Data Retention and Security

We generally retain the information we collect only for as long as necessary to fulfill the purposes for which it was collected, to fulfill our contractual and legal obligations, or as otherwise required by law. When you place an order through the Site, we may retain your information and content for a commercially reasonable time for backup, archival and audit purposes, or we may delete your personal information from our systems as part of a data retention plan and cyber-hygiene policies. We will also delete your personal data when it is no longer needed for any of the purposes described above.

Soda Sense maintains physical, electronic and procedural safeguards that are consistent with industry standards to help protect the privacy, accuracy, and reliability of personal information and to protect it from loss, misuse, unauthorized access, disclosure, acquisition, exfiltration, alteration and destruction.

We also take commercially reasonable steps to ensure that our third-party service providers reasonably protect and secure your information. If Soda Sense becomes aware that a third-party service provider is using or disclosing information improperly, we will take necessary and immediate steps to end or correct such improper use or disclosure.

While we attempt to protect the information in our possession and account for the protection of information provided to our third-party service providers through us, no security system is perfect and we cannot promise that information about you will remain secure in all circumstances. Please do your part to help us keep your information secure. You are responsible for maintaining the confidentiality of your password(s) and your Account(s), and for all activities that occur under your password or Account(s). Soda Sense specifically reserves the right to terminate your access to your Account(s) and any contract you have with Soda Sense related to the use of the Site in the event it learns or suspects you have disclosed your Account or password information to an unauthorized third party.

Your Rights

Consistent with applicable law, you may exercise the rights described in this section. Please note that some of the rights may vary based on your country, province, or state of residence.

The Right to Access, Correct, and Delete Personal Information

Depending on your state of residence in the U.S., you may have the right to: request access to and receive details about the personal information we maintain about you and how we have processed it; correct inaccuracies; get a copy of; or, delete your personal information. You may also have the right to withdraw your consent to our processing of your personal information.

Access, Correction, and Deletion

You can submit a request to access, correct, or delete your personal information, or withdraw consent, by:

We’ll use commercially reasonable efforts in order to comply with such requests. Upon our receipt of a verifiable request to delete personal information, we will delete the personal information from our records and will direct any Service Providers to delete your personal information from their records.

Please note: we may deny your deletion request (and need not ask Service Providers to comply with a deletion request) if retaining the information is necessary to perform certain functions or commitments, including: completing the transaction for which the personal information was collected; providing a service requested; otherwise performing our contract with you or taking reasonably anticipated actions within the context of our ongoing business relationship with you; detecting security incidents and protecting against malicious, deceptive or otherwise illegal activity or to prosecute those responsible for those activities; complying with a legal obligation or otherwise using the personal information, internally, in a lawful manner; fulfilling the terms of a written warranty or product recall conducted in accordance with federal law; or, for a purpose otherwise contemplated in applicable laws where you reside.

Response timing and format

Once you have submitted your request, we will respond within the timeframe required by the applicable law. For example, for California residents, we will confirm receipt of your request within 10 days and provide a response within 45 days, unless we provide you more information or a reason for needing more time. If we require more time to provide a response, we will inform you of the reason and extension period in writing.

Any responses we provide will cover the twelve (12) month period preceding the receipt of your request. If we are not able to comply with your requests, our response will include reasons as to why. If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request.

Identity Verification

We cannot comply with your requests to access, correct, or delete if we cannot verify your identity. A verifiable request must:

- Provide sufficient information that allows us to reasonably verify you are the person about whom we collected Personal Information;

- Describe your request with sufficient detail that allows us to properly understand, evaluate and respond to it.

We reserve the right to require additional information from you to verify your request before we respond. Any personal information provided to us in a verifiable customer request will be used only to verify the requestor’s identity to make the request. We will not ask you for additional, personal information beyond what we have already obtained.

Authorized Agent

Depending on your state of residence in the U.S., you may designate an authorized agent to submit a request on your behalf to access or delete your personal information. To do so, you must: (1) provide written and signed permission that the authorized agent has authority to submit such request; and (2) verify your own identity directly with us. Please note, we may deny a request from an authorized agent that does not submit proof that they have been authorized by you to act on your behalf.

Appealing Requests

Depending on your state of residence in the U.S., you may be able to appeal our decision to your request regarding your personal information. To do so, please contact us at privacy@sodasense.com. We respond to all appeal requests as soon as we reasonably can, and no later than legally required. If you are a resident of Canada, you may have the right to submit a complaint to the Office of the Privacy Commissioner about our decision with respect to your request.

Additional Information for California Residents

In the last twelve (12) months, we have collected the categories Personal Information listed below.

Category A: Identifiers. For example, names, postal addresses, IP addresses, email addresses and other similar identifiers

Category B: Personal Information categories listed in the California Customer Records statute (Cal. Civ. Code § 1798.80(e)). For example, names, addresses, and telephone numbers. In certain instances, we may collect limited, financial information such as a credit card number.

Category F: Internet or other similar network activity. For example, your browsing history, search history, interaction with our websites or advertisements.

We are not aware that we have actively collected Personal Information from California residents for the Categories C-E or G-K over the past twelve (12) month. We continue to review, audit and update these disclosures.

Shine the Light

Under California Civil Code Section 1798.83 (known as the “Shine the Light” law), residents of California may request certain information about our disclosure of Personal Information during the prior calendar year to third parties for their direct marketing purposes. To make such a request, please write to us at the address below or at privacy@sodasense.com with “Request for California Privacy Information” on the subject line and in the body of your message. We will comply with your request within thirty (30) days or as otherwise required by the statute. Please be aware that not all information sharing is covered by the “Shine the Light” requirements and only information on covered sharing will be included in our response.

International Data Transfers

Soda Sense is located in the United States. If you are located outside the United States, the information Soda Sense gathers about you may be transferred, processed, maintained, and accessed outside of your home jurisdiction or in a jurisdiction with different, and less protective, privacy laws. By submitting your personal information to us you agree to the transfer, storage, and processing of your personal information in a country other than your country of residence including, but not necessarily limited to, the United States.

Changes to this Policy

We may update this Privacy Policy from time to time in order to reflect, for example, changes to our practices or for other operational, legal or regulatory reasons. We will notify you of material changes to this Privacy Policy by posting a notice on the Site, communicating with you through the services, or by emailing you at an email address you have provided us.
